What is the workers’ compensation process?

If you get injured at work in California, workers’ compensation can help cover medical expenses and lost wages. Understanding the workers’ compensation process will help you know what steps to take to get the benefits you deserve.

Report the injury

The first step in the workers’ compensation process is to report your injury to your employer. You need to do this as soon as possible—ideally within 30 days of the injury. Reporting promptly helps ensure that you receive benefits without delay. After you report your injury, your employer will provide you with a workers’ compensation claim form (DWC-1) to fill out.

File a claim

After you receive the claim form, fill out your section and return it to your employer. Your employer will then submit the form to their workers’ compensation insurance company. This claim officially starts the process, and the insurance company will begin reviewing your case. Keep a copy of the completed form for your records.

Receive medical treatment

Workers’ compensation covers the cost of medical treatment for your work-related injury. After you report your injury, your employer may direct you to a specific healthcare provider within their network for treatment. If your injury is severe and needs immediate care, you can visit the nearest medical facility. Make sure to inform the healthcare provider that your injury is work-related, so they can bill the workers’ compensation insurance.

Wait for the insurance decision

Once you file your claim, the insurance company will review it and decide whether to accept or deny your claim. If the insurance company accepts your claim, you will begin receiving benefits, including payment for medical bills and temporary disability payments if you cannot work. If the claim is denied, you have the right to challenge the decision through the California Division of Workers’ Compensation.

Return to work

Once your healthcare provider clears you, you can return to work. Depending on your recovery, you may return with modified duties or restrictions. The goal is to help you get back to work safely and as soon as possible.

The workers’ compensation process involves many different steps. By following these steps, you can access the benefits you need to recover and return to work.
